Marquees Over Hawkes Bay Terms & Conditions

1. Rental Charges

All products and equipment are hired on a daily basis – consideration will be given for longer periods (see Extended Terms of Hire below) however unless specified the assumption will be that the hire period is for 24 hours. The hire period starts from the date the equipment is delivered to the hirer’s site or in the case of a collection from the date the equipment is collected from Marquees over Hawkes Bay premises. The hire period ends when the equipment is collected complete from the hirer’s site or it is returned complete to Marquees over Hawkes Bay premises. In the case of hirer returns, penalty charges shall be incurred at the daily hire rate for each day that the equipment is late.

Extended Terms of Hire:

Weekend event (2 days) charged as one day’s hire 2-3 days – charged as 1.5 x one day’s hire

4-5 days charged as 2 x one day’s hire 6-7 days charged as 3 day’s hire

Marquees over Hawkes Bay reserves the right to alter costs at their discretion in the event of cost increases in labour, materials or transport before or during the time of installation.

2. Payment

Marquees over Hawkes Bay does not offer credit to its customers. A deposit of 50% of the total hire value will be charged with order to secure the booking. This deposit is non returnable. Payment of the balance in full is required no later than 8 weeks prior to the event.

3. Cancellation Policy

Our business is very seasonal and Marquees over Hawkes Bay work on the basis of having constant bookings throughout the season. Accordingly, we have to operate a very strict cancellation policy which is as follows:

Cancellation 8 weeks or less prior to the event – 50% of total charge Cancellation 4 weeks or less prior to the event – 100% of total charge.

4. Delivery and Removal of equipment

Marquees over Hawkes Bay will be granted permission by the hirer to access the hirer’s property with vehicles to enable the delivery, erection, dismantling and collection of the equipment. Marquees over Hawkes Bay will not be responsible to the hirer or any other third parties for damage to driveways, lawns, pathways, or underground services due to the weight of Marquees over Hawkes Bay (or associated) vehicles. It is the hirer’s responsibility to notify Marquees over Hawkes Bay of any specific access obstructions, restrictions, underground drains, power or water services or overhead services that may be vulnerable or cause an obstruction during the delivery, installation or collection process. If any of the above are not notified and subsequently cause an impediment to the installation, Marquees over Hawkes Bay reserve the right to rescind the contract or charge for additional time required to execute its duties. Marquees over Hawkes Bay shall not be under any liability whatsoever in respect of damage to drains, pipes or cables or other services buried under the site or otherwise concealed or any consequential loss resulting from such damage unless an accurate plan showing the precise position of such drains, pipes and cables is provided at the commencement of the installation. Plans without scale or clear setting out dimensions will not be deemed as accurate and the cost of any damage caused will be borne by the customer The hirer is responsible for providing Marquees over Hawkes Bay with a plan of where the marquee equipment shall be erected or alternatively shall have a representative on site for that purpose. If the hirer does not provide a plan or have a representative on site, Marquees over Hawkes Bay may erect the marquees and equipment where it considers fit and it shall be deemed to have performed the contract. Any wasted journeys due to absent representatives will be charged for. Deliveries left at unattended premises are left at the hirer’s risk and acceptance of the Inventory Checklist will be assumed. Any specific collection and delivery instructions to be notified in writing (or email) by the hirer at the time of ordering. The hirer, or a third party authorised to represent the hirer, must attend when Marquees over Hawkes Bay collect equipment. If the hirer is not available and fails to appoint a third party to attend when the collection takes place, the hirer will not be entitled to dispute the condition or quantity of equipment returned to Capri Marquees and the acceptance of the Collection checklist will be assumed.

5. Damage

The hirer is obliged to ensure that they take proper care of the hired equipment and will indemnify Marquees over Hawkes Bay against any damage, loss or theft. The hirer will be charged at full replacement cost for any damage or loss upon termination of hire (as set out on checklist). The hirer undertakes that he / she is competent and qualified to use the equipment in the way for which it is designed – ignorance is not an excuse. If the hirer has undertaken a self installation hire all marquees come with explicit assembly instructions. The hirer is responsible for erecting the marquee in line with the instructions and in a manner which will be safe for those using it and which will not lead to damage of the equipment. Marquees can only be erected on flat lawns or soft ground capable of taking a one metre stake and withstanding the weight of vehicles. They cannot be erected on hardstanding or beaches or held in place using weights/blocks. Unless by prior arrangement Damage resulting from hirer misuse shall not lead to a reduction in the hire period or the price payable from the hirer to Marquees over Hawkes Bay. The hirer is responsible for satisfying himself that the equipment hired is suitable for their intended use. Marquees over Hawkes Bay’s equipment may not be new (although some may be) but when delivered to a hirer’s site or collected from Marquees over Hawkes Bay premises all equipment will be in good condition and suitable for its intended use. Marquees over Hawkes Bay will not be liable for any loss or liability suffered by the Hirer as a result of broken equipment regardless of how this breakage may have been caused. In the event of breakage the hirer must immediately notify Marquees over Hawkes Bay. Marquees over Hawkes Bay will not be liable for loss or damage suffered by the hirer or third party as a result of the hirer’s use of the equipment. The hirer will indemnify Marquees over Hawkes Bay against any claim by a third party in respect of any loss, injury or liability as a result of use of the hired equipment. Claims will not be considered unless they are made within seven (7) days of the alleged cause for complaint and in writing to Marquees over Hawkes Bay business address.

6. Permits

The hirer is responsible for obtaining permits or resource consents from the local authority, police, fire, or any similar authority or organization who may have jurisdiction over the site, be it a private or public venue. Any cost as incurred in delays or modifications in the work arising from the absence of or misrepresentation of such permissions and permits shall be payable to the company by the hirer and shall be deemed to be part of the hire charge.

7. Force Majeure

Whilst Marquees over Hawkes Bay will make every effort to carry out every order accepted, the performance of the company is subject to variation or cancellation by the company in the event of act of god, war, strikes, riots, lock-outs or other labour disturbances, fire, flood, excessively inclement weather conditions likely to damage equipment, imposed restrictions on the use of transport, fuel or power, requisitioning, shortage of material or transport or labour or any other cause beyond the control of the company.

8. Electrical Supply

The hirer is responsible for ensuring that there is sufficient available power to supply the equipment being hired for the function. If in any doubt we suggest the employment of a qualified electrical consultant to ascertain the capacity of the existing supply and the anticipated increased electrical load.
